Creator Program — Terms & Conditions

The master agreement governing your participation in the VINTrakID Creator / Affiliate Program.

Acceptance

By registering, you accept these terms and all linked policies referenced below.

Eligibility

You must be at least 18, legally able to contract, and not located in a sanctioned jurisdiction.

License Grant

VINTrakID grants you a limited, revocable, non-transferable, non-exclusive license to promote VINTrakID using approved materials.

Independent Contractor

You are an independent contractor. No agency, employment, partnership, or joint venture is created.

Modifications

VINTrakID may modify these terms; the latest version supersedes prior versions. Material changes require re-acceptance before earning further rewards.

Creator Rules of Engagement

How creators may promote VINTrakID — channels, frequency, and tone.

Approved Channels

You may promote on owned social channels (YouTube, TikTok, Instagram, X, Facebook, blogs, newsletters, podcasts, Twitch) under your own name.

Prohibited Channels

No paid search bidding on VINTrakID brand terms, no spam, no incentivised traffic, no cookie-stuffing, no toolbar/extension installs.

Volume / Frequency

Reasonable, organic posting only. Bot networks, throwaway accounts, and automated engagement are grounds for immediate termination.

Payout Policy

When and how creators are paid — thresholds, methods, holdbacks, and clawbacks.

Payout Threshold

Minimum payout balance is set per campaign and disclosed in the campaign brief. Balances below threshold roll forward.

Payment Methods

Stripe Connect (primary), PayPal (secondary), and ACH (US-only, on request).

Holding Period

Rewards are held for a verification window (typically 30–60 days) to allow refunds, chargebacks, and fraud review.

Clawback

VINTrakID may reverse rewards tied to fraud, chargebacks, refunds, terminated subscriptions, or policy violations.

Tax Reporting

US creators earning $600+/yr receive a 1099-NEC. Non-US creators are responsible for local tax compliance and may be required to complete a W-8BEN.

Content Guidelines

Standards for any content you create that references VINTrakID.

Truthful Claims

Only make claims that are demonstrably true and consistent with VINTrakID published materials. No medical, financial, or legal advice.

No Misrepresentation

Do not impersonate VINTrakID employees or imply official endorsement beyond your creator status.

Quality Bar

Content should be lawful, family-appropriate (PG-13 by default), and free of hate speech, harassment, or graphic content.

IP & Usage Rights

Who owns what — VINTrakID marks, your content, derivative works.

VINTrakID IP

All VINTrakID names, logos, and trademarks remain VINTrakID property. You receive a limited license solely to promote the Program.

Your Content

You retain ownership of content you create. You grant VINTrakID a perpetual, royalty-free, worldwide license to reshare, excerpt, and reference your VINTrakID-related content for marketing.

Reservation

Any rights not explicitly granted are reserved by the respective owner.

Disclosure & FTC Compliance

Mandatory disclosure rules under FTC 16 CFR Part 255 (Endorsement Guides).

Mandatory Disclosure

Every post, story, video, livestream, or written piece referencing VINTrakID must clearly disclose your material connection. Suggested formats: "#ad", "#sponsored", "Paid partnership with VINTrakID", or on-screen badge.

Placement

Disclosure must be visible without expanding "more", before any affiliate link, and within the first 3 seconds of video content.

Region-Specific Rules

EU/UK creators must additionally comply with ASA/CAP and equivalent local advertising rules.

FTC disclosure — copy-paste templates by platform

Use one of the formats below, matched to where the content appears. The platform's own native partnership tag (where available) does not on its own satisfy 16 CFR Part 255 — pair it with the written disclosure.

Tax Documentation (W-9 / W-8BEN)

Tax forms required before payouts can be released.

US Creators

You must submit a current Form W-9 (individual or business). Payouts are paused until on file.

Non-US Creators

You must submit Form W-8BEN (individuals) or W-8BEN-E (entities). Withholding may apply depending on treaty.

Updates

You are responsible for updating your tax documentation if your residency or entity status changes.

Anti-Fraud & Abuse Policy

What we treat as fraud, how we detect it, and what happens next.

Prohibited Conduct

Self-referrals, fake accounts, paid-traffic arbitrage, cookie-stuffing, click-injection, ad fraud, refund abuse, identity falsification, and unauthorised botnets.

Detection

Automated screening (fingerprinting, IP velocity, conversion-quality scoring) plus manual review. Cloudflare Turnstile protects public signup endpoints.

Consequences

Forfeiture of accrued rewards, account suspension or termination, recovery of paid amounts, and referral to law enforcement where warranted.

Confidentiality

How non-public information shared with creators is protected.

Confidential Information

Includes unreleased product details, internal metrics, embargoed campaigns, and any non-public roadmap shared under the Program.

Obligations

You will not disclose Confidential Information to any third party or use it for any purpose other than performing under this agreement.

Term

Confidentiality obligations survive termination for three (3) years, or longer where required by law.

Termination

How either side may exit the Program — voluntarily or for cause.

For Convenience

Either party may terminate at any time with seven (7) days written notice. Accrued (non-clawback) rewards remain payable subject to the Payout Policy.

For Cause

VINTrakID may terminate immediately for material breach, fraud, brand harm, or legal/regulatory risk.

Effect

On termination your license to use VINTrakID IP ends immediately. You must take down active promotional content within 30 days of request.

Dispute Resolution

Where, how, and under what law disputes are resolved.

Governing Law

Delaware, USA (placeholder — counsel to confirm).

Informal Resolution

Parties must attempt good-faith resolution for 30 days before filing.

Binding Arbitration

Final disputes are resolved by binding arbitration administered by JAMS in San Francisco, with limited carve-outs for IP and equitable relief.

Class Action Waiver

You waive any right to participate in a class or representative action against VINTrakID.

Creator Privacy Addendum

Supplements the main VINTrakID Privacy Policy with Creator-specific data handling.

Data We Collect

Identity, payout / tax data, performance metrics, content URLs, and audit-trail signals (IP, user-agent, version accepted).

Why

Run the Program, calculate rewards, pay you accurately, comply with tax and anti-fraud law.

Sharing

Stripe (payouts), tax authorities (1099/W-8), Cloudflare (anti-abuse). See main /privacy for full sub-processor list.

Your Rights

Access, correction, deletion (subject to tax retention), and data portability where applicable.

Engagement Analytics on Campaign Pages

The public /join/{campaign} page records anonymous-only signals — an opaque visitor id (random UUID stored client-side) plus impression / hover / expand / click counts on perks, rewards, FAQs, and CTAs. We do NOT log IP, user-agent, referrer, or anything you typed before submitting. These signals are used solely to tell admins which sections of a campaign page are working and which to delete.

Brand Guidelines

How you may (and may not) use the VINTrakID name, logo, colors, and screenshots.

Logo Usage

Use the official wordmark only. Do not recolor, distort, or apply effects.

Voice & Claims

Stick to claims published on VINTrakID surfaces. No projections, "guaranteed savings", or medical/financial promises.

Co-Branding

No combined logos or implied partnerships without prior written approval.

Creator Code of Conduct

The behaviour we expect on-platform, in DMs, at events, and in your audience interactions.

Respect

No harassment, discrimination, doxxing, or threats. Disagreement is fine — abuse is not.

Honesty

No fabricated reviews, paid-for engagement, or undisclosed sponsorships of competitors while in the Program.

Safety

Comply with all local laws at events, demos, or in-person creator activations.

Acceptable Use Policy

Things you may not do with VINTrakID systems, APIs, links, or referral data.

Systems

No probing, scraping, scanning, or reverse-engineering VINTrakID systems beyond officially documented endpoints.

Links & Codes

Referral codes are non-transferable. No reselling, brokerage, sharing across networks, or use in coupon-aggregator sites without prior written consent.

Data

You may not collect, store, or redistribute VINTrakID user data obtained through promotional activity.

Brand Safety

Categories of content, conduct, and adjacency that put the VINTrakID brand at risk and how we respond.

Prohibited Adjacencies

Do not promote VINTrakID alongside or within: hate speech, harassment, sexually explicit content, gambling, weapons, controlled substances, political endorsements, election manipulation, or content that targets minors. Includes ad placements, video pre-rolls, sponsored read-arounds, and reaction/duet content.

Controversial Topics

Avoid leveraging the VINTrakID brand in ongoing crises, mass-casualty events, communal violence, or active political disputes. When in doubt, pause the promotion and contact us.

Public Persona

Off-platform conduct that materially harms the VINTrakID brand — credible accusations of fraud, harassment, or hate speech — may trigger immediate suspension and reward forfeiture, irrespective of the proximate content.

AI-Generated Content

Disclose use of generative AI in any VINTrakID-related deepfake, synthetic voice, or persona simulation. Do not impersonate VINTrakID staff, customers, or vehicles you do not own.

Remediation

On notice of a brand-safety incident you must take down or correct the content within 24 hours. Repeated incidents or refusal to remediate are termination events under Document 10.

Accept & record

Recording your acceptance creates a permanent audit-trail row (timestamp, IP address, user-agent, version v1.0, and all 16 documents). If the framework changes materially you'll be asked to re-accept before further rewards are paid.
