1. About VINTrakID

VINTrakID provides informational vehicle equity insights derived from aggregated data, analytical models, and publicly or commercially available sources.

VINTrakID:

• Is not a vehicle dealer, insurer, lender, appraiser, or broker
• Does not provide appraisals, guarantees, or valuations
• Does not provide insurance, legal, or financial advice
• Does not make purchasing, underwriting, lending, or pricing decisions
• Is not a Consumer Reporting Agency under the Fair Credit Reporting Act (FCRA)

VINTrakID provides derived, non-authoritative vehicle value ranges generated from public data, proprietary analytics, and predictive modeling. These ranges are for informational and analytical purposes only and do not constitute appraisals, offers, guarantees, or substitutes for resale, trade-in, or valuation services.

2. Eligibility

You must be at least 18 years old to use the Services. By using the Services, you represent that you are legally capable of entering into a binding agreement.

3. Accounts and Access

Account Creation

Some features require creating an account. You agree to provide accurate information and to keep your credentials secure.

You are responsible for all activity under your account.

Account Types

VINTrakID may offer different account types, including:

• Consumer accounts
• Partner or organizational accounts
• Administrative accounts

Access to features depends on your account type and permissions.

Subscription Benefits

Certain subscription plans may include additional benefits such as roadside assistance. These benefits are governed by separate terms:

• Roadside Assistance Rider – applies to eligible paid subscribers

4. Use of the Services

You may use the Services only for lawful, personal, or authorized business purposes.

You agree not to:

• Misuse or interfere with the Services
• Attempt to reverse engineer or scrape data
• Submit false or misleading information
• Circumvent security, rate limits, or access controls
• Use the Services to make automated or bulk VIN queries without authorization
• Represent VINTrakID outputs as appraisals, guarantees, or official valuations

We reserve the right to suspend or terminate access for violations.

5. VIN and Vehicle Data

When you enter a VIN, VINTrakID generates analytical outputs based on available data and models.

Equity intelligence with indicative value ranges used to understand trajectory, risk, and timing.

You acknowledge and agree that:

• VINTrakID outputs are estimates, not guarantees
• Data may be incomplete, delayed, or subject to error
• Results may change over time as data or models change

You are solely responsible for how you use the information provided.

6. Maintenance Intelligence

VINTrakID's Maintenance Intelligence feature provides vehicle maintenance specifications, service timing guidance, and general how-to information.

Important:

• Maintenance specifications are derived estimates based on typical industry guidelines, not official manufacturer specifications
• Service intervals shown represent general guidance and may not reflect your specific vehicle's requirements
• How-to guides are generic and not vehicle-specific; they do not replace your owner's manual or professional advice
• VINTrakID does not reproduce owner's manual text, diagrams, or OEM-specific procedures

Always consult your vehicle's owner's manual or a qualified technician for authoritative maintenance guidance specific to your vehicle.

You acknowledge that:

• Maintenance data is informational only and not a substitute for professional service advice
• Service timing estimates may vary based on driving conditions, climate, and manufacturer updates
• VINTrakID is not responsible for any damage, injury, or loss resulting from reliance on maintenance information
• Critical safety systems should always be serviced by qualified professionals

7. Diminished Value Susceptibility (DVS)

Certain features of the Service may include indicators such as Diminished Value Susceptibility ("DVS"). DVS is provided for general informational purposes only and reflects relative sensitivity to diminished value if an accident occurs, based on vehicle attributes and market-level indicators.

Informational Nature:

DVS is calculated using VIN-derived vehicle attributes and segment-level indicators. DVS scores are subject to value-based tier caps that reflect economic constraints on diminished value potential.

DVS Does NOT:

• Represent an estimate of monetary loss or dollar amounts
• Predict accident likelihood or safety outcomes
• Confirm whether any accident has occurred
• Access accident history, claims data, or vehicle inspection results
• Provide valuations, appraisals, or insurance determinations

No Advice:

DVS is informational only and should not be relied upon for insurance, claims, valuation, purchasing, or any financial decisions. Users should consult qualified professionals for advice specific to their circumstances.

No Accident Prediction:

DVS reflects susceptibility to diminished value if an accident were to occur. It does not assess, predict, or indicate accident likelihood, driving behavior, or vehicle safety.

8. Lifetime Value Index (LVI)

Certain features of the Service may include indicators such as Lifetime Value Index ("LVI"). The LVI is an informational metric designed to offer general insights into vehicle ownership characteristics over time.

LVI scores are not appraisals, valuations, guarantees, forecasts, insurance determinations, underwriting decisions, or financial advice. LVI should not be relied upon as the sole basis for purchasing, selling, insuring, repairing, financing, or otherwise transacting a vehicle.

LVI scores are directional and comparative, not absolute, and may change as vehicle conditions, ownership behavior, market conditions, or available data change.

VINTrakID reserves the right to update or modify the methodology, inputs, or presentation of the LVI at any time without notice.

9. Alerts and Notifications

VINTrakID may offer alerts or notifications based on user-defined preferences or detected events.

Alerts:

• Are informational only
• May not capture all relevant events
• Should not be relied upon as the sole source of information

VINTrakID does not guarantee the accuracy, completeness, or timeliness of alerts.

10. Reports, Exports, and Buyer's Package

Any reports, summaries, exports, or Buyer's Package documents generated through the Services:

• Are provided for informational purposes only
• May not be sold, redistributed, or used commercially without permission
• Must include all disclaimers when shared
• Do not constitute appraisals, guarantees, or official valuations

Buyer's Package:

The Buyer's Package feature generates PDF reports containing vehicle information, Equity Health Score, DVS tier, and service documentation. These documents are intended to help vehicle owners share information with potential buyers.

• Buyer's Package reports are informational summaries, not certifications
• VINTrakID does not verify the accuracy of user-submitted service records
• Recipients should independently verify vehicle information before making purchasing decisions
• The inclusion of service records does not guarantee their completeness or accuracy

10. Partner Connections and Leads

If you choose to connect with a third party partner through VINTrakID:

• Sharing occurs only with your explicit consent
• VINTrakID does not endorse or recommend any partner
• Any relationship formed is solely between you and the third party

11. Intellectual Property

All content, software, models, designs, trademarks, and materials in the Services are owned by or licensed to VINTrakID and are protected by intellectual property laws.

You may not copy, modify, distribute, or create derivative works without prior written consent.

Your use of the Services is subject to the VINTrakID Privacy Policy, which explains how information is collected, used, and protected.

You agree to indemnify and hold harmless VINTrakID, its affiliates, officers, directors, and employees from any claims, losses, damages, liabilities, and expenses arising from:

• Your use of the Services

• Any actions taken based on maintenance information provided

16. Termination

VINTrakID may suspend or terminate access at any time, with or without notice, for conduct that violates these Terms or poses risk to the platform.

You may stop using the Services at any time.

17. Changes to the Services or Terms

We may modify the Services or these Terms from time to time. Updated Terms will be posted with a revised effective date.

Continued use after changes constitutes acceptance.

18. Dispute Resolution and Arbitration

You and VINTrakID agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved through binding individual arbitration, rather than in court, except that either party may seek injunctive relief in court for intellectual property matters.

BY AGREEING TO THESE TERMS, YOU WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTIONS OR CLASS-WIDE ARBITRATION.

Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in English, and judgment on the award may be entered in any court of competent jurisdiction.

Opt-Out: You may opt out of this arbitration agreement by sending written notice to legal@vintrakid.com within 30 days of first accepting these Terms.

19. Governing Law and Venue

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws principles.

Any legal action or proceeding arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located within the State of Delaware, and you hereby consent to the personal jurisdiction and venue of such courts, except where prohibited by applicable law.
